1. Disclaimer of Warranties. We make no warranty of any kind regarding the Loyalty Scheme, which is provided on an "as-is" and "as-available" basis. We expressly disclaim any representation or warranty that our scheme will be error-free. We further disclaim any warranty as to the accuracy, completeness and timeliness of any content or information distributed with respect to the Loyalty Scheme. We expressly disclaim all warranties and conditions, including implied warranties and conditions of merchantability, fitness for a particular purpose, title, non-infringement, and those arising by statute or otherwise in law or from a course of dealing or usage of trade.
2. No cash redemption. Loyalty Points have no cash value. Loyalty Points are not redeemable for cash, and can only be redeemed for products on our webite. The sale of Loyalty Points is strictly prohibited.
3. No Waiver. Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. No waiver of any of the provisions of these Terms shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall any waiver constitute a continuing waiver unless otherwise expressly provided.
4. Release of Liability. You release us, along with our officers, directors, employees and agents from and against any and all liability relating to your membership or participation in the Loyalty Scheme and its Terms along with our general Privacy Policy and Terms and Conditions.
5. Severability. If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms, which will otherwise remain in full force and effect.
6. Entire Agreement. These Terms constitute the entire Loyalty Scheme agreement between you and us. They supersede all prior or other arrangements, understandings, negotiations and discussions, whether oral or written.
7. Changes to the Loyalty Scheme.
7.1. We reserve the right to add to and/or change the Loyalty Scheme at any time, at our sole discretion. This may include changing the number of Loyalty Points earned for various actions and activities, or changing what activities and actions are eligible for Loyalty Points. In addition, we may change the number of Loyalty Points required to redeem. We may also change the value of each Loyalty Point.
7.2. Any changes or modifications to the Loyalty Scheme will be effective immediately upon posting the revisions to this page, and you waive any right you may have to receive specific notice of such changes or modifications. Your continued participation in the Loyalty Scheme will confirm your acceptance of such changes or modifications, and your agreement to be bound by these Terms and any changes or modifications thereof; therefore, you should review these Terms frequently to understand the terms and conditions that apply to the Loyalty Scheme. If you do not agree to the revised Terms, you must notify us by contacting us on sales@llangollenbrewery.com or in writing via our contact us form.
7.3. We reserve the right to terminate the Loyalty Scheme with 3 months prior notice. Your right to earn Loyalty Points and redeem accumulated Loyalty Points will terminate three months after we give you this notice.
8. Violation of Terms. We may terminate your account and you will forfeit all accumulated Loyalty Points if you violate these Terms. We reserve the right to freeze or terminate the Loyalty Scheme account of any person in the event of any fraud or abuse in connection with this Loyalty Scheme. In such a case, all Loyalty Points in the account will be forfeited. Llangollen Brewery reserves the right to modify, remove, delete or change Loyalty Points in any account that were done in error, whether human or computer error.
9. The interpretation and application of these Terms are in the sole discretion and determination of us, which in each case shall be final and conclusive. Loyalty Scheme is void where prohibited by law.
